Terms of Use

These terms govern the use of the VivreEnsemblePrep mobile app and the website vivre-ensemble-prep.luxify.lu, published by Julien Kessels. By downloading the app or using the site, you accept these terms. If you do not accept them, do not use the service.

1. Purpose of the service

VivreEnsemblePrep is a practice tool for people preparing the Luxembourg civic education test “Vivre ensemble au Grand-Duché de Luxembourg”. The service includes multiple-choice questions, explanations with extracts from public teaching material, a timed mock exam, progress tracking and an exam guide.

The service is a revision aid. It is neither a certified training course, nor legal advice, nor an administrative procedure.

2. No official affiliation

VivreEnsemblePrep is an independent app. It is not published, approved, endorsed or sponsored by the Government of the Grand Duchy of Luxembourg, the Ministry of Education, Children and Youth, the Service de la formation des adultes, the Ministry of Justice, or any other organiser of the official exam.

Our questions are not the questions used in the official paper, and no official question bank is published. Using the app in no way guarantees success in the exam or the acquisition of Luxembourg nationality.

Information about sessions, registration, locations, languages and applicable rules changes over time. The official portal always prevails over the content of the app and of this site.

3. Access to the service and accounts

The app requires no account. Access to Premium features is linked to the purchase made with your Apple ID.

You are responsible for the security of the device on which the app is installed and of the Apple ID used for your purchases.

The service is intended for adults, or for minors with the authorisation of their legal representative.

4. Free version and Premium subscriptions

The app is free to download. The free version allows thirty practice questions a day and gives access to all three subjects, the sourced explanations, the five languages and progress tracking.

The Premium subscription unlocks practice without the daily limit and the complete forty-question mock exam in sixty minutes.

Several plans may be offered: weekly, monthly, quarterly, yearly, and a one-off purchase granting lifetime access. The plans actually available, and their prices, are those displayed in the app at the time of purchase.

Prices shown on this site are indicative, in euros and inclusive of tax. The price applied to you is the one displayed by the App Store in your country and currency at the time of the transaction.

5. Payment, renewal and cancellation

All payments are processed by Apple through the App Store. We collect, process and store no payment data.

Subscriptions renew automatically at the end of each period unless cancelled at least twenty-four hours before the renewal date. The renewal amount is charged to your Apple account within the twenty-four hours preceding the end of the current period.

Cancellation is done in your Apple account settings, under “Subscriptions”. It takes effect at the end of the period already paid for, during which you keep Premium access. We cannot cancel a subscription on your behalf.

The one-off purchase granting lifetime access is not a subscription: it does not renew and requires no cancellation. “Lifetime” refers to the commercial lifetime of the app and is not a commitment to perpetual maintenance.

6. Right of withdrawal and refunds

As a consumer resident in the European Union, you are in principle entitled to a fourteen-day right of withdrawal on purchases of digital content. That right is exercised with the seller, meaning Apple, not with us.

Refund requests must be sent to Apple via reportaproblem.apple.com, using the Apple ID that made the purchase. Apple applies its own conditions and decides on the outcome alone.

We have neither the technical access nor the contractual power to initiate, speed up or guarantee a refund. We can, however, guide you through the process if you write to us.

7. Intellectual property

The app, the site, their code, design, visual identity and logo, the wording of the questions, the structure of the explanations and all texts written by us are protected by copyright and remain our exclusive property or that of our licensors.

We grant you a personal, non-exclusive, non-transferable and revocable licence to use the app for your own exam preparation.

The following are prohibited in particular: reproducing, extracting, republishing or reselling all or part of the questions and explanations; using the content to feed, train or evaluate any automated system or machine-learning model; reverse engineering the app; and using the content for commercial purposes or group training without prior written authorisation.

Extracts of teaching material quoted in the explanations are used for educational and illustrative purposes, with their origin indicated. Rights in those documents remain with their respective authors and publishers. Official names and trade marks mentioned belong to their holders and are used descriptively only.

8. Acceptable use

You agree not to disrupt the operation of the service, not to attempt to circumvent its usage limits or payment mechanisms, not to access the service by automated means, and not to use it for unlawful purposes.

We may suspend access to the service in the event of a clear breach of these obligations.

9. Accuracy of the content and its limits

The content is prepared carefully from public sources and reviewed regularly. It is nonetheless provided “as is”, without any warranty of completeness or absence of error.

The rules, syllabus and organisation of the exam may change without our being immediately informed. You remain solely responsible for checking official information with the competent authorities before taking any step.

If you spot an error or an imprecision, tell us: we verify every report and correct the content where justified.

10. Availability of the service

The app works offline for most of its features. An internet connection is still required to buy or restore a subscription.

We aim to keep the service available and compatible with recent versions of mobile operating systems, without guaranteeing uninterrupted availability. Interruptions may occur for maintenance, updates or reasons beyond our control.

11. Limitation of liability

To the extent permitted by law, we cannot be held liable for failing an exam, for the refusal of a nationality application, for loss of opportunity, for indirect damage, for the loss of progress data, or for any consequence resulting from official information changed after our content was published.

Our total liability, all damages combined, cannot exceed the amount you actually paid for the service during the twelve months preceding the triggering event.

Nothing in these terms excludes or limits our liability in the event of wilful misconduct, gross negligence or personal injury, nor affects the mandatory rights granted to you by consumer protection legislation.

12. Changes to these terms

We may amend these terms to reflect changes in the service or the law. The date of the last update appears at the top of this page.

In the event of a substantial change affecting an ongoing subscription, you will be informed in the app. Continuing to use the service after that notice constitutes acceptance of the new terms.

13. Governing law and jurisdiction

These terms are governed by Luxembourg law.

Any dispute falls within the jurisdiction of the courts of the judicial district of Luxembourg. If you are acting as a consumer, this clause does not deprive you of the right to bring proceedings before the court of your place of residence where European rules allow it.

In accordance with Regulation (EU) No 524/2013, the European Commission provides an online dispute resolution platform for consumer disputes at ec.europa.eu/consumers/odr.

Apple Inc. and its subsidiaries are third-party beneficiaries of these terms to the extent that they concern use of the app obtained through the App Store, and may rely on them. Apple's standard end user licence agreement applies in addition.
